Киевский апелляционный хозяйственный суд определил экспертом по проведению экспертизы патента на препарат для ВИЧСПИДа торговой марки "Алувиа" фармкомпании "Эббви Инк" (AbbVie Inc, США) лицо, предложенное компанией. Согласно сообщению Всеукраинской сети людей живущих с ВИЧСПИДом (Сеть ЛЖВ), суд в ходе заседания 8 февраля, отклонил предложенного организацией эксперта – кандидата наук, преподавателя НМУ им. Богомольца и назначил экспертом сотрудника Институт эндокринологии и обмена веществ им. В.П. Комисаренко НАМН Украины, которого предложила в качестве эксперта компания "Эббви Инк". Ожидается, что результаты экспертизы будут готовы в течение трех-четырех месяцев. Как сообщалось, Сеть ЛЖВ в мае 2016 года подала иск в Хозяйственный суд Киева относительно признания патента на препарат "Алувиа" с действующим веществом "лопинавир/ритонавир" недействительным, мотивируя это несоответствием требований законодательства относительно новизны и изобретательского уровня препарата, а также завышением цен на него. Отмена патента по оценкам организации позволит закупать препарат в три раза дешевле и обеспечить им дополнительно 125 тыс. украинских пациентов. В марте 2017 года хозсуд отклонил иск, посчитав, что оспариваемый патент не нарушает права или охраняемые законом интересы истца, а его отмена не гарантирует снижение цены на препарат. Киевский апелляционный хозяйственный суд 4 октября 2017 года принял решение о назначении экспертизы патента на препарат для лечения ВИЧ/СПИДа с действующим веществом "лопинавир/ритонавир", на закупку которого Украина тратит около $19,5 млн ежегодно, что составляет около 40% бюджета, предусмотренного на все лекарства для ВИЧ-позитивных пациентов. При этом лечением обеспечиваются только 26 тыс. пациентов. Компания AbbVie, основанная в январе 2013 года в результате отделения от Abbott, работает в более чем 170 странах мира. Портфель препаратов включает как растущие бренды, так и уже известные на рынке препараты для лечения и профилактики ревматоидного артрита, псориаза, болезни Крона, ВИЧ/СПИД и других аутоиммунных заболеваний. Всеукраинская сеть людей, живущих с ВИЧ/СПИД, является крупнейшей пациентской организацией Украины, которая имеет региональные ячейки во всех регионах Украины, объединяет 11,755 тыс. ассоциированных участников и 506 действительных членов, предоставляет услуги около 70 тыс. клиентов по всей Украине, а в руководящий состав организации могут входить исключительно ВИЧ-позитивные лица.
